I. Legal professionals, chamber affiliation and professional regulations

The legal professionals who work for the law firm are admitted to the bar in the Federal Republic of Germany. Admission to the bar extends throughout the territory of the Federal Republic of German. The statutory occupational title is “Lawyer”.

The lawyers who work for the law firm are members of the Rechtsanwaltskammer (Bar Association) Frankfurt am Main, Bockenheimer Anlage 36, 60322 Frankfurt am Main, tel: +49 (0)69/170098-01, Fax 069/170098-50, which is at the same time the relevant supervisory authority.

Among others, the following professional law provisions apply:

  • Bundesrechtsanwaltsordnung (Federal Lawyers Act) (BRAO)
  • Berufsordnung für Rechtsanwälte (The professional code for lawyers) (BORA)
  • Fachanwaltsordnung (Specialist Lawyers' Regulations) (FAO)
  • Gesetz über die Vergütung der Rechtsanwältinnen und Rechtsanwälte (Federal Code of Lawyers' Fees) (RVG)
  • Council of the Bars and Law Societies of the European Community (CCBE).

II. Professional indemnity insurance

According to the Federal Lawyers Act (Bundesrechtsanwaltsordnung, BRAO), lawyers are obliged to take out a professional indemnity insurance policy with minimum insurance cover of € 250,000.00. The details are set out in § 1 of the BRAO.

All the firm’s lawyers have taken out the following indemnity insurance policy: Allianz Deutschland AG, Königinstraße 28, 80802 Munich.

The geographical scope of each indemnity insurance policy extends to the entire EU areas and the states of the Agreement on the European Economic Area.

III. Measures to prevent conflicts of interest

Lawyers are subject to a general prohibition against a conflict of interests (§ 43a para. 4 of BRAO). Therefore the Winterstein | Rechtsanwälte partner company checks whether there is a conflict of interest before accepting a retainer.

IV. Settlement of disputes

In the case of disputes between lawyers or disputes between a lawyer and his/her client, there will, if requested, exist an opportunity for the extrajudicial settlement of disputes by the arbitration centre at the relevant law chambers (for us the Law Chamber of Frankfurt am Main) in accordance with § 73 paragraph 2 item 3 in conjunction with § 73 paragraph 5 of the BRAO.

1. Data that is transmitted automatically

The following information will automatically be logged when accessing the web-server.

  • IP address of the computer making the request
  • The date and time of the request, the method of access/function preferred by the requesting computer, entry values transmitted by the requesting computer (e.g. file name).
  • Access status of the web server (file transmitted, file not found, etc.)
  • Name of the requested file
  • URL, from which the file and/or desired function was requested

An entirely anonymous use of this website is possible if the user connects to the site via an access provider using dynamic IP-addresses. In these cases it is not possible for the operators of this offer to determine the identity of the user. Nevertheless, if necessary, user information can be obtained from the access provider via a formal mandate from the relevant authorities.

2. Collection, processing and use of user data

No personal data will be collected, stored or processed except the aforementioned information that is automatically logged. Data supplied voluntarily by the user (e.g. for the purpose of applying as a lawyer or trainee lawyer) will be merely be used for the purpose of communicating with the user or for an internal inspection of the application documents transmitted. This data will never be directly transmitted to third parties.

3. Information, revocation, deletion

The users of this offer have the option at any time of demanding information on the personal data concerning them that is stored with the operator. A user’s personal data shall be immediately deleted upon request. The deletion is omitted, however, if the data is still urgently needed and the operator is authorised by law to process or use this data without the consent of the individual.

If personal data is processed or used solely as a result of the consent of the person concerned, the person concerned has the right to withdraw their consent at any time. In cases where the person concerned makes use of this right, the operator shall immediately delete the personal data.
